Former US President Donald Trump has officially appealed the decision to ban him from participating in the Republican Party primaries in Colorado. The Supreme Court in that state ruled against him for his role in the 2021 Capitol storming.
The appeal is before the US Supreme Court.
Trump wants to participate in the presidential elections next November. But the states of Colorado and Maine banned him from participating in the primaries. This is the election that determines who the Republican and Democratic parties will run as candidates.
The states decided this based on a clause in the Constitution. This provision stipulates that persons who caused the uprising may not hold public office. In Maine, the chief elections official made the decision. Trump has also appealed in that state.
Trump's lawyers do not believe the former president participated in the insurrection
Trump is the first presidential candidate in American history to be ineligible to enter the White House under this provision. The Colorado Supreme Court said in December that Trump had been “disqualified.”
The Supreme Court said that Trump, during a speech on January 6, 2021, incited the mob that stormed the Capitol. In addition, Trump was not protected by the First Amendment to the US Constitution, which guarantees freedom of expression.
Trump's lawyers disagree. They refute Trump's participation in the insurrection and believe the Supreme Court should hear the case.
